These Terms of Service ("Terms") are a binding agreement between you and PostSmarter, Inc. ("PostSmarter"). By creating an account or using the service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and authorized to act on behalf of your business. Banking and payments services are provided by our partner banks, subject to their terms.

2. Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

3. Fees

Current fees are listed on our pricing page. We may change fees on 30 days' notice. You authorize us to debit fees from your account.

4. Acceptable use

You agree not to use the service for any unlawful, fraudulent, or prohibited activity. See our Acceptable Use Policy for details.

5. Suspension and termination

We may suspend or terminate your account if you breach these Terms, present an unacceptable risk, or as required by law. You may close your account at any time.

6. Disclaimers

The service is provided "as is". To the maximum extent permitted by law, we disclaim all warranties, express or implied.

7. Limitation of liability

Our aggregate liability under these Terms is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

8. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Disputes shall be resolved by binding arbitration in San Francisco, CA.

9. Changes

We may update these Terms; material changes will be notified at least 30 days in advance.
